Car Rental Agreement Between Car Rental Drives & Client

This Car Rental Agreement is made and signed as of ………………Date………………, between ……………………………Company………………………., and …..Client………………….

This Agreement is subject to the following terms and conditions:

We hereby agree to rent to …………………… the following vehicle with registration Number…………………………………………For a period of ………………………………From:……………………………Time:………………To:…………………………… The Parties agrees that this Agreement terminates upon the End Date specified above. Notwithstanding anything to the contrary in this Agreement or any Exhibits, either Party may terminate this Agreement prior to the End Date with at least one (1) day notice, a refund of Rental Fees.

2. PAYMENTS BY CLIENT

• The client shall pay for the Vehicle From Car Rental Drives Africa at an agreed sum or sums agreed upon during Reservations, and all payments can be made in USD………………..or Euros………….. Or any currency …………………… as per the operator standard exchange rate. ( US Dollar Notes accepted by the Company starts from 2009 print notes and above).
• All Payments for the rental are always made cash upon arrival or by bank transfer to our USD Account at least 2 weeks prior to the arrival/pick up date. Additionally all Visa / credit card are subjected to a 5% surcharge of the actual value being paid
• In addition to the payment specified above, the client ensures that she/he will be liable at the end of the hired period to pay the Car Rental Drives any applicable additional charges that may arise during the rental period, including the extended period, late return of the vehicle ( $50 for every extra hour) contrary to the time agreed upon, between both parties.
• During the rental period, the vehicle may not be used for the conveyance of passengers and/or goods for reward, to propel or tow any other vehicle, (including any caravan or trailer; to transport goods in violation of any customs laws or in any other illegal manner; in any motor sport or similar high risk activity; beyond the borders, or in any area where there is or may be a risk for incidents of civil unrest, political disturbance or riot or any activity associated with any of the a foregoing unless authorized by the company in writing.
• Traffic fines and street parking tickets /fines must all be settled by the hirer during the rental period.
• The company is not liable for any fuel expense during the rental period, fuel/oil expense will be met by the client of the vehicle during the period and a client is supposed to take regular maintenance and checks on the car for the rental period.
• The client must leave behind a Security deposit fee of $500, which has to be refunded fully in case the vehicle returns in great condition as to when it was hired out, otherwise Car Rental Drives Africa shall retain this deposit to be used, in the event of loss or damage to the Vehicle during the term of this Agreement, to defray fully or partially the cost of necessary repairs or replacement

3. EXISTING DAMAGE TO VEHICLE.

Both Car rental Drives Africa & the Client must acknowledge the existing damage to the Vehicle as notated below:

4. CLIENT’S OBLIGATIONS

The client must :

1. Ensure proper care when driving and parking the car, so that in case of any damage, he/she will take full responsibility including the costs of repair, to check oil and water levels in the car and purchasing fuel from responsible major fuel stations.
2. Cover the tire puncture cost. Due to the road terrains, flat tires are usually un avoided, the cost is then subjected to the client but when it’s beyond repair a new one will be bought by the Company/Operator at a shared cost.
3. Report any unusual with the car. In case a warning light appears on the dashboard, clients are urged to make known of the problem to the company

5. COMPANY’S OBLIGATIONS

We will provide the Vehicle in a safe and roadworthy condition, displaying valid Third-party insurance.

6. MECHANICAL REPAIRS AND ACCIDENTS

1. If the vehicle is involved in an accident, is damaged, breaks down or requires repair regardless of cause, the client shall report to the Company of the entire incidence
2. The Client must not arrange or undertake any repairs or leave the scene of the accident before police inspection or without the company’s notice
3. The client must make a statement to the nearby police, when the accident occurs. If the statement is found to have some fraudulent intention, a person will be liable for making a false statement when they knowingly and willfully falsify, conceal, or cover-up by any trick, scheme, to a fine of extra $5000
4. If the vehicle requires to be repaired, the company shall arrange repairs to the vehicle within a reasonable time frame depending on the location of the breakdown, if the breakdown was a result of a breach of Section 4, the client will meet all the costs incurred
5. Following a mechanical breakdown, we will provide a replacement car within 24 Hours when in the same country, and 48 hours across the border. The Company shall be responsible for the replacement of the car while the client responsible for the fuel of the broken-down car to return to pick up address.
6. All clients must maintain a maximum speed limit of 40km/hr, any accident arising inside any protected area or national park is 100% a responsibility of the hirer to settle the matter to zero balance, please note that insurance doesn’t cover any damages caused within the national park, like knocking wild animals and fines and accidents within the parks the hirer is reliable to solve his personal Insurance.

7. INSURANCE

Our vehicles are insured under a policy of motor vehicle insurance (“Policy”) from a person or company licensed to carry on insurance business as per the following the Insurance Act, which only covers, Head Collusion and theft of the Vehicle , excluding Personal Life Insurance for the client.

This Insurance does not cater for any damage caused by negligence, like drunken driving, wheels/trims, cigarette burns. Yet it still doesn’t cover tires, tools, windscreen, side mirrors or any burned vehicle part to the interior of the vehicle, radio /MP4 screen, reversing camera, lights, body parts, engine parts or any other parts related to the vehicle accessories, as these are full responsibilities of the client plus the actual towing storage impound and other related expenses.

If at all the vehicle is driven under your driver’s negligence: you shall be debited for any damage caused to the engine/ battery, radiator or cylinder head due to your negligence.

As discussed earlier, clients are urged to quickly report to the police, if another party’s guilt is to be discovered, or any person is injured. It is from this claim, that the company as well as the insurer will base on to cover the damage.

The Excess insurance charged by the operator will vary depending on the car type: Toyota Rav4 & Nissan Xtrail at USD 500, Land cruiser Prado TZ & TX 1500 USD, Luxury jeeps: LX 7.0 Series, V8, GX, TXL land cruisers Excess insurance at is $ 2000USD.

The client with adhere to the terms and conditions of the insurance policy and pay the owner any excess in the event of the claim

Rooftop Tents and camping gears are not insured, therefore in case of any damage, the client shall pay the costs incurred, at their actual cost price i.e. replacing the tent at the original cost as per the Quotation from Manufacturing Tentco at $1000usd.

Note That: The Company doesn’t provide insurance services to the Clients, but only manages the insurance provided under the Policy provided by the insurance company. The Company reserves the right to determine whether or not to claim under the Policy. In the event of damage to the vehicle, the client agrees to immediately notify, and solely deal with the Operator.

8. THE CLIENT WILL NOT BE COVERED UNDER THE POLICY

The client will be 100% responsible When:

• Driving in excess of speed limits. A fine of 80 US$ as per Section120 Traffic Act, where the speed is limited to 80Km/hr. on the highway and 50km/hr. in places with heavy traffic
• Single vehicle accidents or rollover will call in a fine of $ 1000 USD plus the Excess damage in section 7 of the Agreement.
• All damages to the vehicle caused by careless, reckless driving, Engine Knocking (passing through deep water, is subjected to a fine US$ 1000 for Rav4 and Toyota Land cruiser US$ 1500.)
• Damage to the vehicle is caused by lack of proper care as clause 4
• Driving on restricted roads/areas like off-tracking in Kenya, Tanzania, Uganda, Rwanda, and Burundi National Park.
• During weather conditions like the rainy season, the client has to take care when driving in muddy areas and avoid passing in deep areas
• Underbody coverage, damage to the underbody of the vehicle is considered a result of careless
• Cross Border Insurance: Our vehicles are insured for use in the country of pick up only, but the client shall not attempt to take the vehicle across the border without prior authorization from the Company and the hirer must buy COMESA Insurance which is processed by the operator at $50 for 2 weeks, $70 for 20 days.
• Clients crossing the border to another country must provide proof of an exit confirmation from the foreign country visited and failure to do so, a surcharge of 200$$$ will be demanded to drive the car back to that country to exit
• Clients must use from specified petrol stations, of Total & Shell, and avoid the restricted ones, for the safety of the engine.

9. DRIVING TIME & ADVICE.

• The vehicle must not be driven beyond 1830 hrs and should start at 0630hrs am , for whatever happens beyond this time, will be met by the client, hence a fine of 1200$ will be paid to the Company.
• When the car is hired with a driver guide, driving will stop at exactly 1900hrs , while night game drives can be done by the hotels
• Speed Limit in National Parks is restricted to 40KM/hr and off track driving is not allowed, is it will be at one’s own risk, and penalties are 100% subjected to the Client.
• Animals in the National Parks are guaranteed a 100 % Right of way and clients must maintain a 100Metres distance from Animals like Elephants. The company wont be held for damages to the car.

The client is responsible for the charges and fines resulting from animal accidents in the park.

10. FUEL & GASOLINE

Clients must check the level of fuel during the time for picking up the Vehicle, the same amount at which the car must be returned. No credit will be refunded for the unused fuel.

11. BREACH OF THE CONTRACT

This Agreement, with all Exhibit(s), is signed after the entire agreement between the Company and the client, following Vehicle Hire subject matter. This hereby supersedes all agreements, proposals, representations and other understandings, oral or written from both parties and any current or additional order(s) provided by Affiliate.

If any part of this Agreement is held to be invalid or unenforceable ,no alteration or modification of this Agreement or any Exhibits shall be accepted unless made in writing and authorized by the Company

In case the client cause an accident (while on self-drive), he/she will be provided a company driver for remaining rental period at driver-guide fee depending on which country you will be driving.

12. Cancellation Policy:

• 60 days prior to pick up date 25% (Booking Fee) is retained by the company.
• 59 – 35 days before pick up, 50% of cost is retained is retained by the company
• 34 – 15 days before arrival/pick up, 75% is retained by the company
• 14 days or less before pick 100% is returned, with no refund
